Could Someone Have Prevented Your Car Accident?

It can be devastating and frustrating to know that your accident or the accident that injured a close loved one could have been prevented. If the drunk driver wouldn’t have gotten behind the wheel, so much trauma and pain could have been avoided.

Most individuals know that a drunk driver can be held liable for damages after he or she causes an accident. Fewer people are aware that social hosts can also be liable if they knew or should have known a guest was intoxicated and allow the guest to leave. This is known as social host liability.

Who Is A Social Host?

The most common type of social host is the individual who throws a party. At any party where liquor is served, the host must take care to make sure that no one who is intoxicated gets behind the wheel or otherwise endangers other people or property. If a drunk guest is involved in an accident, then the party host can be held liable for injuries and property damage.

This liability also extends to situations involving minors. If a parent serves alcohol to a minor and that minor is involved in an accident, the parent may be liable. Additionally, if parents suspect their child will throw a party, the parents can be held liable for any injuries that result from the consumption of alcohol at that party.
