Comparative Fault

Connecticut courts operate under a modified “comparative fault” rule, which will reduce a victim’s awarded compensation by the percentage they are found to be at-fault for their injury. For example, if a claimant is found 10 percent liable in a car accident and the defendant 90 percent. The claimant’s awarded settlement will be reduced by 10 percent. Under this system, even plaintiffs who are partially liable can receive damages. Since the decision on the percentage of blame is a key factor, it is critical to have an experienced attorney on your side if you’ve been hurt in an accident caused by someone else’s negligence.

Statute of Limitations

States differ in the amount of time they allow for victims to pursue damages in personal injury cases. This is known as the statute of limitations, and the amount of time given in Connecticut varies based on the type of claim.
